Crypto Regulations: Shifting to Asia – Can the US Catch Up?

Analysis: The Rise of High-Growth Economies in Crypto Regulations

The landscape of cryptocurrency regulations is undergoing a significant shift, with high-growth economies in Asia and the Middle East taking the lead. Unlike the United States, which has struggled to establish clear and consistent crypto regulation frameworks, these countries are creating tailored frameworks that are more effective and conducive to the growth of the digital asset industry.

The Struggle of the US in Crypto Regulations

The US has faced challenges in regulating the crypto industry, with regulatory entities like the SEC often taking hostile and inconsistent measures. High-profile lawsuits against Ripple and Coinbase have cast a shadow over innovation, prompting some crypto firms to relocate to more crypto-friendly countries. The absence of clear guidelines from the SEC has left founders and investors uncertain about their next moves, fearing potential legal trouble. The attempt to fit digital assets into existing laws, such as securities and commodities regulations, has been a major issue, as these laws were not designed for crypto in the first place.

Emerging Markets: The Hidden Gem of Regulations

In contrast, high-growth markets like Indonesia and Malaysia have introduced a new approach to crypto regulations, recognizing digital assets as commodities rather than enemies. Indonesia’s Commodity Futures Trading Regulatory Agency (BAPPEBTI) officially classified all digital assets as commodities as early as 2019. Malaysia’s Securities Commission created a comprehensive framework for crypto exchanges, including high standards for licensing, investor protection, and anti-money laundering. These measures have reduced fraud, improved trust, and made using crypto safer.

The Thriving Asian Crypto Market

The Asian crypto market is thriving as a result of these regulatory efforts. The Indonesian crypto market surpassed $30 billion in transactions from January to October 2024, a 350% increase compared to the previous year. It is now the third-largest country globally for cryptocurrency adoption, just ahead of the US. In fact, seven of the top 20 countries in the Global Crypto Adoption Index are in Central and Southern Asia and Oceania, indicating that the crypto world is becoming a multipolar industry.

Crypto Utility in Emerging Markets

High-growth markets are leading in crypto utility, addressing pitfalls such as high remittance costs and limited access to owning assets and investing. On average, remittance fees are around 6.65% of the amount sent, which can take a significant portion out of what workers send back to their families. In the Philippines, remittances make up nearly 10% of the country’s GDP. Digital assets also serve as a hedge against inflation, with tokenized gold enabling consumers to own a digital fraction of gold at a lower price.

Predictions: The Future of Crypto Regulations

The future of crypto regulations will be defined by the ability of governments to create tailored frameworks that address real-world use cases. High-growth economies in Asia and the Middle East are setting the standard, and the West risks being left behind if it doesn’t catch up. The US, in particular, needs to revamp its approach to crypto regulations, moving away from a one-size-fits-all approach and embracing a more nuanced understanding of digital assets.

As the crypto industry continues to evolve, we can expect to see:

  • Increased adoption of crypto in emerging markets, driven by the need for financial inclusion and access to assets.
  • More countries following the lead of Indonesia and Malaysia in creating comprehensive frameworks for crypto regulations.
  • A shift in the center of gravity of the crypto industry, with Asia and the Middle East becoming major hubs for innovation and growth.
  • The development of more sophisticated regulatory frameworks that balance innovation with investor protection and anti-money laundering measures.

Ultimately, the future of crypto will be defined by its ability to solve real-world problems and address the pitfalls of traditional finance. As high-growth economies continue to lead the way in crypto regulations, we can expect to see a more vibrant and inclusive crypto industry that benefits people around the world.
